What Every DQ File Must Include (49 CFR Part 391)

These are the documents the FMCSA examiner will request first during a compliance review. Every single one must be present and current.

Employment Application
10-year employment history, license info, accident record, violation history. Must be current version with all signatures.
REQUIRED · ANNUAL
Motor Vehicle Record (MVR)
Pre-employment MVR + annual review MVR from every state licensed in the past 3 years. CFR-fresh required.
REQUIRED · CURRENT
Medical Examiner's Certificate
Valid medical card on file at all times. Expiration tracking critical — operating with expired medical = $1,000 violation.
REQUIRED
Certificate of Road Test
Or certificate of driver’s road test from previous employer within last 3 years. Must specify vehicle type tested.
REQUIRED · ANNUAL
Annual Review of Driving Record
Annual certification that driving record was reviewed, signed by carrier representative, and placed in DQ file.

Previous Employer Inquiries
Must contact each DOT-regulated employer from past 3 years within 30 days of hire. Must document responses.

Current CDL copy on file. Endorsements verified against vehicle types operated. License number current.

CONDITIONAL

Entry-Level Driver Training (ELDT)
Required for drivers obtaining their CDL after February 7, 2022. Training Provider Registry completion certificate.

Annual Driver Certification
Annual certification of violations or no violations for the preceding 12 months. Driver-signed, dated, filed.
CONDITIONAL
Hazmat Endorsement Records
Security threat assessment records, training documentation for applicable drivers transporting HAZMAT.
1. Expired Medical Certificates

3. Annual MVR Reviews Not Completed

Annual MVR reviews must be documented with a signed acknowledgment in the file.
